People do not need to file criminal complaints, seek arrests, or meet with district attorneys to get courts to issue orders of protection or restraining orders. The New York Family Court allows people to obtain orders of protection or restraining orders in limited circumstances.

Orders of protection typically come in two types, with stay-away or full orders establishing that people must stay away and have no direct contact with a victim. There are also limited orders that ask people to refrain from committing any criminal offenses or family offenses.

How Orders of Protection Work in New York

An order of protection can order a person to:

  • Stay away from a protected person and children and any place they frequent such as work or school
  • Not commit acts that would be harmful
  • Allow one party to go to a residence with law enforcement to recover property
  • Return important documents to a protected party
  • Allow a protected person to terminate a lease
  • Surrender firearms

An order of protection can also allow the Family Court to give custody of children to the petitioner, make provisions for visitation, require payment of child or spousal support, require payment of a petitioner’s legal costs, place a respondent under probation supervision, require a respondent to pay medical costs, require a respondent to attend abusive partner intervention program, and order anything else that is required to further the purposes of protecting the petitioner and children.

Family court judges often issue orders of protection when a family offense is committed, such as disorderly conduct, harassment, assault, sexual abuse, menacing, reckless endangerment, strangulation, stalking and criminal mischief. Victims then file family offense petitions with the Family Court clerk, and a judge can issue a temporary order of protection when there is good cause.

When a person is arrested for a criminal offense or family offense, then a judge can also issue an order of protection during arraignment. Supreme Court judges may also issue orders of protection as part of divorce orders.

Temporary orders of protection last until the next court date but may be extended until a case is resolved. Family Court orders of protection can last up to two years, although aggravating circumstances may lead to orders lasting up to five years.

Final orders of protection from criminal courts can last up to eight years. An order of protection from the Supreme Court will be permanent.
